Welcome to Paxton Chocolate Terms & Conditions of use. All contracts are with Paxton Chocolate. All orders are subject to these Terms & Conditions. By placing an order you agree to be bound by the Terms & Conditions set out below. Please feel free to call on 01273 670 700  if you have any queries, and we will be pleased to help you.

FORMATION OF CONTRACT/LAW OF THE CONTRACT

In order for you to be able to purchase products from Paxton Chocolate website and in order for us to be able to make a legally binding contract with you, you must let us have certain information. This includes your real name, telephone number, e-mail address, debit or credit card information, as well as any other information that we may ask you to provide.

You warrant that the debit or credit card for which you give us the details is your card and you warrant that it is valid and that you have authority to use it for this transaction. In seeking to enter into any transaction with us, you warrant that you are at least 18 years old.

The details you supply will be subject to checks by card issuers, and by offering to purchase goods you specifically authorise us to transmit information or to obtain information about you from third parties, including, but not limited to, your debit or credit card number or credit reports. This information may be used to authenticate your identity, validate your credit card, obtain an initial credit card authorisation and authorise individual purchase transactions.

We reserve the right to refuse to accept any debit or credit card without being obliged to give you any reason for doing so. Paxton Chocolate reserves the right not to proceed with any order for any reason. But if we do not proceed with your order, we will inform you of this.

A contract for the sale of goods between you and Paxton Chocolate will come into being as soon as your goods have been despatched, unless we have notified you before that time that we cannot accept your order (for whatever reason), or if you have cancelled your order before it is despatched (see “Cancellation” below). Please note that this does not affect your statutory rights.

Ownership of the goods will pass to you as soon as Paxton Chocolate has received payment in full of the price of the goods and the cost of postage and packaging.

If your card issuer does not for any reason make the agreed payment to us, that contract to which that payment relates is automatically cancelled and at an end, and Paxton Chocolate shall be entitled should it choose to do so to decline to accept any further orders from you or to enter into any further contracts with you. Paxton Chocolate is not liable for any loss you may suffer if there is any delay or failure to fulfil an order where payment has not been made for that order.

It is up to you to make sure that you have ordered the correct goods and given us the correct personal and debit or credit card details. We will help you by sending an e-mail with confirmation of your order, but it is up to you to review the goods and the quantity in that e-mail carefully. We are not liable in any way if you have ordered the wrong goods or quantity, and we are not liable in any way if we are unable to despatch goods as a result of any failure by you to supply accurate personal or debit or credit card details. If we are unable to perform any of our obligations to you under the contract, including if there is delay or failure to despatch any goods that you have ordered, Paxton Chocolate will not be liable to you for any breach of contract or any loss or damage however it is occasioned, if such failure is due to matters beyond our reasonable control.

The contract between Paxton Chocolate and you is made in the United Kingdom (which is where Paxton Chocolate is based, where the goods are despatched and where its website is hosted) and you and Paxton Chocolate agree that it shall be governed by the laws of England and you and Paxton Chocolate both irrevocably submit to the exclusive jurisdiction of the English courts.

It is your responsibility to make sure if you are outside the United Kingdom that any goods that we supply adhere to any relevant laws of the place to which they are to be sent.

CANCELLATION/RETURNS

You may cancel your contract with Paxton Chocolate for any reason by giving written notice to Paxton Chocolate to arrive at Paxton Chocolate’s offices within 24 hours of the time when you placed the order, provided your order has not already been despatched. A cancellation can be made by fax, letter or e-mail. It is up to you to make sure, if you want to cancel, that the notice is received by us in time. If you choose to send a letter in the post it may well arrive after the 24 hours have passed. E-mail is not always instantaneous, and can be delayed, depending who your ISP is, so please also be aware of this.

If you cancel within the 24 hour period, any payments you have made, including for postage and packaging, will be refunded in full.

If your goods have already been despatched, and you wish to return them, we are happy to accept them and to provide a refund on condition that they are returned in perfect condition, unused and in their original packaging. We will not provide a refund if you do not do this. Your rights to return goods are protected under the EU Distance Selling Directive which can be found at www.hmso.gov.uk/si/si2000/20002334.htm

COST/DELIVERY

All prices displayed on the Paxton Chocolate website are given in pounds sterling and do not include VAT (this stands for Value Added Tax and is a UK sales tax) as Paxton Chocolate is not a VAT registered business.

You are responsible for the payment of any taxes or duties in any place outside the United Kingdom to which your order is despatched by us.

The total cost of your order includes the price of your products and postage and packaging charges. Please see Deliveries and Returns for further information on delivery charges.

We do everything we can to meet our delivery timetables, but sometimes we will be unable to do so. Please bear with us if there are very occasionally delays. However, we are not liable for any losses of any kind caused by failure to meet a delivery date that we have given you.

Prices on the website are subject to change without notice. If this occurs after the time that you place your order we will inform you before we despatch it. The same is true if we notice that our website has a pricing error on it. We will not despatch the goods until we have your agreement to the revised price.

PRODUCT DESCRIPTION

We do all that we can to ensure that all information on our website, such as dimensions and specifications, is correct. Sometimes it is possible that there may be errors. Paxton Chocolate will correct all such errors as soon as it can after it becomes aware of them, but is not liable for any loss or damage caused by them.

Please be aware that as our chocolates are hand made there can be variations within products and that the product on your screen may differ from how it appears on the product itself.

CHANGES TO TERMS & CONDITIONS

Paxton Chocolate reserves the right to alter these Terms & Conditions. It reserves the right to do so at any time, and is not obliged to give notice other than placing them on its website. When altered by notice via the website, they apply to any orders received the time of alteration.

We do not store credit card details nor do we share customer details with any 3rd parties.
